Privacy Policy

ROUCHETTE, a simplified joint stock company with a capital of 188,000 euros registered with the Angers Trade and Companies Register under number 353 603 814 and whose registered office is Z.I. du Bordage - 49122 Le May-sur-Evre, is the controller of the processing of personal data carried out via the Site.

In this capacity, ROUCHETTE undertakes to comply with the provisions of Law No. 78-17 of 6 January 1978 (known as "Informatique et Libertés") as amended and those of the General Data Protection Regulation (known as "GDPR").

The Site is hosted by Médiapilote on OVH servers located in Roubaix (France). Personal Data is hosted on secure servers located in France and under conditions compliant with the GDPR.

End-purposes

The Personal Data provided by the User to ROUCHETTE is subject to computer processing and is stored and used by ROUCHETTE for the following purposes:

  • to allow you to access the Site and, where applicable, some reserved areas, as well as use its various functionalities;
  • to save and manage your shopping cart, orders and provide you with the relevant products;
  • to communicate with Users in response to their requests and solicitations;
  • to manage requests, orders, payments and product returns/exchanges,
  • to provide you with after-sales service, answer your questions, complaints and manage or respond to any legal disputes or requisitions (e.g. fraudulent use of a credit card);
  • to measure the Site's performance, and for example the number of pages viewed or the number of clicks;
  • to manage any contests or promotional operations offered on the Site, and in particular the designation of the winner(s) and the awarding of the prize(s);
  • to send Users, at their request or following an order, newsletters, information messages and/or promotional offers.

 

In addition, when the User visits the Site, navigation data may be collected and processed by ROUCHETTE or by any service provider (third party) of its choice for statistical purposes and/or to improve the presentation and use of the Site, and in particular to measure and improve the number of pages viewed, the number of visits and the User's experience on the Site.

Legal basis for the processing operations

Some of the processing operations carried out by ROUCHETTE in accordance with the purposes set out above are necessary to enable ROUCHETTE to:

  • fulfil its contractual obligations towards Users;
  • comply with its legal obligations;
  • respond to some legitimate interests, in particular those relating to the management of its commercial activities.

In all other cases, processing carried out by ROUCHETTE is possible in so far as the User has expressly consented to it.

Security of personal data

ROUCHETTE undertakes to take all technical and organisational measures to ensure the protection and security of Personal Data, in particular against any loss, alteration, distribution or illegal use.

ROUCHETTE ensures that such measures are implemented on all operations carried out in the context of its processing, and in particular during the collection, storage and hosting of Personal Data.

In this respect, ROUCHETTE also ensures that the third parties it may call upon comply with this requirement to protect Users' Personal Data by implementing appropriate measures. The technical and organisational measures put in place may include the use of secure registration forms, encryption of certain data (such as bank data), and restricted access to Personal Data.

ROUCHETTE invites Users to exercise the greatest caution in communicating their Personal Data, on their own, to third parties.

Some messages or requests received may come from malicious persons seeking to obtain personal information about Users for fraudulent use (phishing). Should Users receive a message that appears to be an attempt at phishing, they are asked not to reply to it and not to open any attachments, images or links contained in the message. Users may report such messages by e-mail to serviceclients@rouchette.com and on www.signal-spam.fr

Recipients of personal data

Users' Personal Data is intended for ROUCHETTE; however, it may be communicated by the latter to third party subcontractors to ensure access to and use of the Site and its services.

Users' Personal Data is not communicated or transferred to third parties for commercial or promotional purposes, except with the express prior consent of the said Users.

The Users' decision to receive offers or commercial prospecting messages from ROUCHETTE and/or its partners is subject to its prior and express agreement by means of a corresponding checkbox, to be ticked when providing Personal Data (for example when ordering). Should a User no longer wish to receive them, that User may unsubscribe at any time using the link at the bottom of each of the messages received or by contacting ROUCHETTE by e-mail: serviceclients@rouchette.com

In certain cases, ROUCHETTE may communicate the User's Personal Data to any administrative or judicial authority that requests it, in accordance with the legislation in force.

Transfer of personal data outside the European Union

During its activities, ROUCHETTE may transfer the User's Personal Data to persons or entities located outside the European Union, in the following countries: [to list].

It is possible that some of the third countries in which the User's Personal Data is transferred may apply less protective legislation to Personal Data. In this case, ROUCHETTE implements the appropriate guarantees to ensure that the User's Personal Data benefit from a level of protection in accordance with the applicable rule.

Storage period for personal data

ROUCHETTE will only store the User's Personal Data for a limited period of time, determined according to the nature of the data in question and the processing concerned.

On this basis, the User's Personal Data will be kept for the following periods of time:

  • Identification data: 36 months from the last log-in;
  • Order data: 36 months from the date of the order;
  • Bank data: maximum 13 months from the date of provision;
  • Prospect data: 12 months after the last activity on the Site.

Once these periods have elapsed, some of the Personal Data in question may be archived for accounting management purposes and for the management of disputes or requisitions, for a period not exceeding the legal requirements in these matters.

User rights

According to the amended "Informatique et Libertés" law and the GDPR, Users have the right to access, rectify or delete all or part of their Personal Data, the right to object to the storage or limit the processing of their Personal Data, and the right to portability of Personal Data, which they may exercise by addressing a letter to: ROUCHETTE, Customer Service, Z.I. du Bordage - 49122 Le May-sur-Evre, or by e-mail at: serviceclients@rouchette.com

For processing operations dependent on User consent, Users also have the right to withdraw their consent at any time.

Users are informed that the exercise of these rights does not affect the validity of the processing operations carried out previously, nor the right of ROUCHETTE to archive some of the Personal Data in question, regarding to the principles above mentionned.

Such requests must be submitted by the User personally and in writing, signed and accompanied by a photocopy of an identity document bearing the signature of its holder. This information will be processed only for the purpose of identifying the User and will not be stored  for a period longer than that necessary to process the response. The request shall specify the e-mail or postal address to which any reply should be sent. ROUCHETTE will have one (1) month to respond following receipt of the request.

Users also have the right to file a complaint with the authorities, and in particular with the CNIL.

Use of cookies

A "cookie" is a file sent by a website when it is visited, and stored in Internet browsers.

Generally, cookies are used to facilitate navigation on a website, to keep a product in the shopping cart before purchase or to measure and evaluate the behaviour of Users who visit a website (number of visitors, duration of visits, most visited elements...).

There are several types of cookies, some of which are non-identifying, and others that are identifying. Some cookies may be combined with other data to personalize the User's experience on a website. When cookies are identifiable, they allow the collection and processing of Personal Data.

ROUCHETTE uses cookies when the User browses the Site. These cookies are used to ensure that an order is placed, to measure the number of visitors to the Site and to provide ROUCHETTE with information on how the User circulates on the Site, and to improve the User's experience on the Site.

The cookies used by ROUCHETTE are stored for a maximum period of 13 months from their first deposit on the User's computer.

It is also possible that third parties use cookies to collect data related to the User's navigation. ROUCHETTE is in no way responsible for operations related to the use of third-party cookies.

Modification of privacy policy

This Privacy Policy may be modified by ROUCHETTE at any time.

In the event of a change to the Privacy Policy, the new version in effect will be applicable to the Users immediately upon their login to the site.

In the event of a dispute between the User and ROUCHETTE, the Privacy Policy to be taken into account shall be that in force at the time of the facts giving rise to the dispute.
